EX CM शिवराज सिंह की बढ़ी मुश्किलें ! वीडी शर्मा, भूपेंद्र सिंह के खिलाफ मानहानि का मुकदमा दर्ज, जानिए किसने और क्यों ठोका केस ?
भोपाल: मध्य प्रदेश के पूर्व मुख्यमंत्री शिवराज सिंह चौहान, बीजेपी प्रदेश अध्यक्ष वीडी शर्मा और पूर्व मंत्री भूपेन्द्र सिंह के खिलाफ मानहानि का मुकदमा दायर किया जाएगा. दरअसल, कांग्रेस के राज्यसभा सदस्य वरिष्ठ अधिवक्ता विवेक तन्खा ने जिला न्यायालय में शिकायत दर्ज कराई थी कि ओबीसी आरक्षण मामले की सुनवाई के दौरान प्रदेश के मुख्यमंत्री शिवराज सिंह, वीडी शर्मा और भूपेन्द्र सिंह ने वकील विवेक तन्खा के खिलाफ गलत बयानबाजी की।
क्यों दायर किया गया मानहानि का केस ?
वरिष्ठ वकील विवेक कृष्ण तन्खा ने मांग की थी कि तीनों वरिष्ठ बीजेपी नेताओं के खिलाफ एमपी एमएलए कोर्ट में मानहानि का मुकदमा दायर किया जाए. मामले की सुनवाई करते हुए एमपी एमएलए कोर्ट के विशेष न्यायाधीश विश्वेश्वरी मिश्रा ने तीनों के खिलाफ आईपीसी की धारा 500 (IPC 500) के तहत मामला दर्ज करने के निर्देश जारी किए हैं.
गौरतलब है कि सुप्रीम कोर्ट में पंचायत और निकाय चुनाव से जुड़ी याचिका पर सुनवाई के दौरान राज्यसभा सांसद और वकील पैरवी के लिए मौजूद थे. आरोप है कि सुप्रीम कोर्ट द्वारा ओबीसी आरक्षण पर रोक लगाने के कारण इन बीजेपी नेताओं ने सांसद और वकील विवेक तन्खा के खिलाफ बयानबाजी की थी.
तीनों को 10 करोड़ का मानहानि नोटिस
बताया गया कि विवेक तन्खा की ओर से बीजेपी के तीन वरिष्ठ नेताओं को 10 करोड़ रुपये का मानहानि नोटिस जारी किया गया था. जब नोटिस का कोई जवाब नहीं मिला तो उन्होंने 6 जनवरी 2023 को जिला अदालत में शिकायत दर्ज कराई. शिकायत की सुनवाई के दौरान उन्होंने 29 अप्रैल 2023 को अदालत के समक्ष अपना बयान दर्ज कराया.
कोर्ट में अपने बयान में राज्यसभा सांसद ने कहा कि उन्होंने सुप्रीम कोर्ट में ओबीसी आरक्षण से जुड़ी कोई बात नहीं कही है. उन्होंने मध्य प्रदेश में पंचायत और निकाय चुनाव के मामले में परिसीमन और रोटेशन की मांग करते हुए सुप्रीम कोर्ट में वकालत की थी, लेकिन जब सुप्रीम कोर्ट ने चुनाव में ओबीसी आरक्षण पर रोक लगा दी तो बीजेपी नेताओं ने साजिश रचकर इसे गलत तरीके से पेश किया.
बीजेपी नेताओं ने गलत बयानबाजी की
राज्यसभा सांसद ने कहा, ‘सीएम शिवराज सिंह चौहान, वीडी शर्मा और भूपेन्द्र सिंह ने गलत बयान देकर ओबीसी आरक्षण का दोष मुझ पर मढ़ दिया. उन्होंने मेरी छवि खराब कर आपराधिक मानहानि की है।
पूर्व महाधिवक्ता और वरिष्ठ अधिवक्ता शशांक शेखर ने बताया कि सुप्रीम कोर्ट ने त्रिस्तरीय पंचायत चुनाव में ओबीसी के लिए आरक्षित सीटों को लेकर फैसला दिया था. इस फैसले के बाद सीएम शिवराज सिंह, वीडी शर्मा और भूपेन्द्र सिंह ने विवेक तन्खा के खिलाफ गलत टिप्पणी की और उनकी छवि खराब करने की कोशिश की.

Why was the defamation case filed?
Senior lawyer Vivek Krishna Tankha had demanded that a defamation case be filed against the three senior BJP leaders in the MP MLA court. While hearing the case, Special Judge of MP MLA Court Visveshwari Mishra has issued instructions to register a case against the three under section 500 of IPC.
It is noteworthy that during the hearing of the petition related to Panchayat and civic elections in the Supreme Court, Rajya Sabha MPs and lawyers were present for advocacy. It is alleged that due to the ban on OBC reservation by the Supreme Court, these BJP leaders had made statements against MP and lawyer Vivek Tankha.
Defamation notice of Rs 10 crore given to all three
It was told that a defamation notice of Rs 10 crore was issued to three senior BJP leaders on behalf of Vivek Tankha. When no response was received to the notice, he filed a complaint in the district court on January 6, 2023. During the hearing of the complaint, he recorded his statement before the court on 29 April 2023.
In his statement in the court, the Rajya Sabha MP said that he has not said anything related to OBC reservation in the Supreme Court. He had advocated in the Supreme Court demanding delimitation and rotation in the case of Panchayat and civic elections in Madhya Pradesh, but when the Supreme Court banned OBC reservation in elections, BJP leaders conspired and misrepresented it. .
BJP leaders made wrong statements
The Rajya Sabha MP said, ‘CM Shivraj Singh Chouhan, VD Sharma and Bhupendra Singh made false statements and put the blame of OBC reservation on me. He has committed criminal defamation by maligning my image.
Former Advocate General and senior advocate Shashank Shekhar told that the Supreme Court had given the decision regarding reserved seats for OBCs in the three-tier Panchayat elections. After this decision, CM Shivraj Singh, VD Sharma and Bhupendra Singh made wrong remarks against Vivek Tankha and tried to tarnish his image.
